The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents:
348-21-PL001A and
348-21-PL101A.
Reason: To define the permission.
The development hereby permitted shall not be first used until full details of all foul and surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter.
Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan.
The Development hereby approved shall not be occupied until the first 10 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material.
Reason - In the interests of highway safety in accordance with Policies SWDP 4 and SWDP 36 of the South Worcestershire Development Plan.
The development hereby approved shall not be brought into use until the visibility splays shown on Drawing 348-21-PL101A have been provided. The splays shall at all times be maintained free of level obstruction exceeding a height of 0.6m above the adjacent carriageway.
Reason: In the interests of highway safety in accordance with Policies SWDP 4 and SWDP 36 of the South Worcestershire Development Plan.
The Development hereby approved shall not be occupied until an area has been laid out within the curtilage of the dwelling for the parking of 8 cars at a gradient not exceeding 1 in 8. This area shall thereafter be retained for the purpose of parking a vehicle only.
Reason - In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway in accordance with Policies SWDP 4 and SWDP 36 of the South Worcestershire Development Plan.
This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email [email protected]. The applicant is solely responsible for all costs associated with construction of the access.
The applicant's attention is drawn to the need to ensure that the provision of the visibility splay(s) required by this consent is safeguarded in any sale of the application site or part(s) thereof.
Before the first use of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:
(i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread.
(ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas.
(iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants.
(iv) a written specification outlining cultivation and other operations associated with plant and grass establishment.
(v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
Before the development hereby permitted is first used, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP1, SWDP21 and SWDP25 of South Worcestershire Development Plan and to ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Prior to installation, details of a bat roosting feature and bird nesting box shall be submitted to and approved in writing by the Local Planning Authority. The details to be submitted shall include an implementation timetable. The features shall be provided in accordance with the approved details and in accordance with the approved timetable.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The holiday caravans hereby approved shall be occupied for holiday purposes only and shall not be occupied as a person or persons’ sole, or main place of residence.
Reason: The proposed units would be situated in the open countryside, outside any defined settlement boundary where new residential development will be strictly controlled. The proposed unit/accommodation is only acceptable as tourism development in accordance with policy SWDP 36 of the South Worcestershire Development Plan. To grant permission without such a condition would be contrary to policy SWDP2 and SWDP 36 of the South Worcestershire Development Plan .
There shall be no more than 4 units placed on the site at any one time as shown on the Proposed Site Plan DWG No. 348-21-PL101A submitted with this application. Any caravan positioned on the site shall meet the definition of a caravan as set out in section 29 of the Caravan Sites and Control of Development Act 1960 and section 13 of the Caravan Sites Act 1968.
Reason: To define the permission hereby granted and to ensure the appearance of the site is satisfactory and causes no harm to the visual
amenities of the area in line with policy SWDP25 and SWDP36 of the South Worcestershire Development Plan 2016.
The holiday caravans hereby permitted shall not be first occupied precise details of the floor levels of each caravan relative to the existing ground levels have been submitted to and approved in writing by the local planning authority. Thereafter the approved floor levels shall be maintained for the lifetime of the development.
Reason: To ensure the proposed development is not affected by surface water flooding in accordance with policies SWDP28 and SWDP29 of South Worcestershire Development Plan.
Prior to the first use of the development hereby permitted, details of refuse storage facilities to serve the development shall be submitted to and approved in writing by the Local Planning Authority. The approved refuse storage facilities shall be implemented prior to the first occupation of the associated development and retained thereafter.
Reason: To ensure adequate refuse storage facilities are incorporated in the development and/or ensure high quality design in accordance with policies SWDP21 and SWDP33 of the South Worcestershire Development Plan.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:
- seeking further information following receipt of the application and considering the imposition of conditions.
In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
The development hereby permitted shall not be first used until details of the design and external materials of the mobile holiday caravans have been submitted to and approved in writing by the Local Planning Authority. The change of use shall be implemented in accordance with the approved details.
Reason: To ensure the development successfully assimilates into the landscape character of the area in accordance with Policies SWDP 21 and SWDP 25 of the South Worcestershire Development Plan.
