Reason: To define the permission.
Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays. Reason - To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan.
Prior to the first occupation of any dwelling hereby approved secure parking for cycles to comply with the Council’s standards shall be provided within the curtilage of each dwelling and these facilities shall thereafter be retained for the parking of cycles only. Reason - To comply with the Council’s parking standards
Before the first use/occupation of the development hereby permitted a plan indicating the positions, design, materials and type of boundary treatment to be erected (with the exception of the rear boundaries of plots 1-6 and the existing fence extending behind the balancing pond) shall be submitted to and approved in writing by the local planning authority. The boundary treatment shall include holes/spaces of sufficient size for small mammals to pass through. The boundary treatments shall be completed in accordance with a timetable agreed in writing by the local planning authority. Development shall be carried out in accordance with the approved details.
Reason - To protect the amenities of properties and ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and to ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan
The hard landscaping of the site shall be completed in accordance with the details approved in relation to 18/02688/FUL.
Reason - To ensure the proposed development represents high quality design and does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
All planting and seeding/turfing comprised in the submitted landscape scheme, hereby approved, shall be carried out in the first planting season following the first occupation/use of the development. All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment. Any trees or plants that die, or are removed; or become seriously damaged or diseased within a period of five years from the completion of the planting, shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan 2016.
The approved renewable or low carbon energy generating facilities approved in relation to 18/02688/FUL shall be provided prior to any part of the development hereby permitted being first occupied or in accordance with a timetable submitted to and approved by the local planning authority as part of the details required by this condition.
Reason: To ensure the proposed development includes sufficient renewable/low carbon energy generating facilities to comply with Policy 27 of the South Worcestershire Development Plan 2016.
The development shall be carried out, and the drainage maintained/managed, in accordance with the drainage details approved in relation to application 18/02788/FUL.
Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan.
Only external lighting in accordance with details approved under 18/02688/FUL shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP1, SWDP21 and SWDP25 of South Worcestershire Development Plan and to ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Prior to the commencement of the use of the access by any vehicular traffic, visibility splays shall be provided from a point 0.6m above ground level at the centre of the junction of the proposed estate road to the application site and 2.4 metres back from the nearside edge of the adjoining carriageway, measured perpendicularly, for a distance of 47 metres in each direction along the nearside edge of the adjoining carriageway, Shinehill Lane. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above and these areas shall thereafter be retained and kept available for visibility purposes at all times.
Reason: In the interests of highway safety.
Prior to the commencement of the use of the shared access serving plots 23, 24 and 25 by any vehicular traffic, visibility splays shall be provided from a point 0.6m above ground level at the centre of the shared access serving plots 23, 24 and 25 and 2.4 metres back from the nearside edge of the adjoining carriageway, (measured perpendicularly), for a distance of 43 metres in each direction along the nearside edge of the adjoining carriageway. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above and these areas shall thereafter be retained and kept available for visibility purposes at all times.
Reason: In the interests of highway safety.
Prior to the first occupation of the development hereby permitted, the whole length of the existing narrow footway parallel to Shinehill Lane fronting the application site shall be widened to 2m constructed width. Existing vehicular drop kerbing accesses made redundant by the proposed development are required to be permanently closed.
Reason. In the interests of highway safety.
The development shall not be occupied until the junction, estate road and footway widening to Shinehill Lane necessary to provide access from the nearest publicly maintained highway have been completed in accordance with details submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure an adequate and acceptable means of access is available before the dwellings are occupied.
All road works shall be completed within a period of two years or other period agreed in writing from the commencement of work on the site, or within six calendar months of the substantial completion of 75% of the building(s) {no. of dwellings} hereby approved if this is sooner. This will entail the making good of surfacing, grassing and landscaping in accordance with a specification submitted to and approved in writing by the Local Planning Authority. (Nothing in this condition shall conflict with any phasing scheme, in which respect it will be interpreted as applying to the particular phase being implemented).
Reason: In the interests of highway safety and convenience and a well co-ordinated development.
The dwellings hereby permitted shall not be occupied until individual vehicular accesses, entrances, individual driveways, forecourts, turning areas, car and cycle parking have been properly consolidated, surfaced, drained and otherwise constructed in accordance with details to be submitted to and approved in writing by the Local Planning Authority and these areas shall thereafter be retained and kept available for those uses at all times.
Reason: In the interests of highway safety.
The Construction Environment Management Plan approved in relation to 18/02788/FUL shall be adhered to throughout the construction period.
Reason: To prevent indiscriminate parking in the interests of highway safety
Upon the first occupation of any dwelling hereby approved a Welcome Pack which promotes sustainable forms of access to the site. This plan will be implemented and updated in agreement with Worcestershire County Councils Travel plan co-ordinator.
Reason: To reduce vehicle movements and promote sustainable access
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- providing pre-application advice; - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
If it is the Developer’s intention to request the County Council, as a Highway Authority, to adopt the proposed road works as maintainable at the public expense, then details of the layout and alignment, widths and levels of the proposed road works in relation to the development and off site works which shall comply with the County Council’s requirements, together with all necessary drainage arrangements and run off calculations shall be submitted to Worcestershire County Council’s Network Control Manager Directorate of Economy and Infrastructure County Hall, Spetchley Road, Worcester WR5 2NP (telephone 01905 763763). No works on the site of the development shall be commenced until these details have been approved and an Agreement under Section 38/278 of the Highways Act, 1980, entered into.
It is not known if the proposed roadworks can be satisfactorily drained to an adequate outfall. Unless adequate storm water disposal arrangements can be provided, the County Council, as Highway Authority, will be unable to adopt the proposed roadworks as public highways. The applicant is, therefore, advised to submit the Engineering details referred to in this conditional approval to the County Council's County Network Control Manager, Worcestershire County Council, County Hall, Spetchley Road, Worcester, WR5 2NP at an early date to enable surface water disposal arrangements to be assessed.
The applicant’s attention is drawn to the need to ensure that the provision of the visibility splays required by this consent is safeguarded in any sale of the application site or parts thereof.
This permission does not authorise the laying of private apparatus within the confines of the public highway .The applicant should apply to the Worcestershire County Council’s Community and Response Unit, County Hall, Spetchley Road, Worcester WR5 2NP (telephone 0845 607 2005), for consent under the New Roads and Streetworks Act 1991 to install private apparatus within the confines of the public highway. Precise details of all works within the public highway must be agreed on site with the Highway Authority.
The applicant’s attention is drawn to the requirement that, in all cases where an Agreement under Section 38/278 of the Highways Act 1980 is entered into, the street lighting will be designed by the developer of the site in accordance with the design brief issued by the Highway Authority and their design shall include any necessary amendments to the existing system.
The applicants attention is drawn to the existence of an agreement made under Section 106 of the Town and Country Planning Act 1990 (as amended), and the restrictions imposed therein.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Ecological Appraisal reference RSE_1875_R1-V2 by RammSanderson dated November 2019, the ecology plan ref. RSE_1875_FO2-V4 and Precautionary Method of Works in relation to Amphibians by Ramm Sanderson dated July 2019 as submitted with this application. In particular but not restricted to:
- precautionary measures for bats, birds and amphibians, such as pre-start checks, and ensuring that bats and nesting birds are not disturbed during demolition and clearance works;
- provision of a bat loft, bat roosting, bird nesting and hedgehog boxes; and
- avoidance of external lighting near bat roosts.
On completion of works the development shall be inspected by a qualified ecologist and a statement of conformity and a copy of any bat licences as appropriate shall be submitted to the Local Planning Authority to confirm whether all of the measures for enhancing biodiversity have been implemented in accordance with the details approved under this condition.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017.
