The mobile unit hereby permitted shall be removed from the site and the land restored to its condition within three years from the date of this permission. Reason: The mobile unit is only justified on a temporary basis until the economic viability of the associated enterprise is established in line with policy SWDP19 of the South Worcestershire Development Plan. To avoid the long term establishment of a separate unit of residential accommodation in an isolated location without sufficient justification in accordance with policy SWDP2 of the South Worcestershire Development Plan.


Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents –

Reason: To define the permission.


Any mobile home placed on site in pursuance of the consent hereby approved shall be finished in accordance with the external colours approved in relation to planning consent 19/01723/CU. The associated fence approved in relation to that consent shall be provided and retained on site for as long as the mobile home is on site.

Reason - To ensure that the new materials are in keeping with the surroundings and/or represent high quality design in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan.


The occupation of the temporary dwelling hereby permitted shall be limited to a person or persons solely, mainly working, or last employed full time in equine activities at Sterling Stables, Boston Lane, Charlton including any dependants of such a person or a widow or widower or surviving civil partner of such a person and any dependants or children residing with his/her widow, widower or surviving civil partner.

Reason - The council would not be prepared to grant consent for the proposed development, unconnected with the use of adjoining land for equine activities given the location of the site within the open countryside in accordance with Policies SWDP2 and SWDP19 of the South Worcestershire Development Plan.


Positive and Proactive Statement.

In dealing with this application, the Council has worked with the applicant in the following ways;

- seeking further information following receipt of the application; and
- considering the imposition of conditions

In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.


The applicant must be aware of their obligations towards the public right of way as follows: No disturbance of, or change to, the surface of the path or part thereof should be carried out without written consent (this includes laying concrete, tarmac or similar) No diminution in the width of the right of way available for use by the public. Building materials must not be stored on the right of way. Vehicle movements and parking to be arranged so as not to unreasonably interfere with the public's use of the right of way. No additional barriers are placed across the right of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the Highway Authority. The safety of the public using the right of way is to be ensured at all times.


A public right of way crosses the site of this permission. The permission does not authorise the stopping up or diversion of the right of way. The right of way may be stopped up or diverted by Order under Section 257 of the Town and Country Planning Act, 1990, provided that the Order is made before the development is carried out. If the right of way is obstructed before the Order is made, the Order cannot proceed until the obstruction is removed.
