Reason: In the interests of clarity and to ensure the development is built in accordance with the details considered in determining the application.


No development shall begin until a Construction Environment Management Plan (CEMP) has been submitted to and approved in writing by the Local Planning Authority. The CEMP shall include the following details:
• details to minimise the impact of noise, vibration and dust from construction, demolition and site clearance activities and the traffic associated with this development, including a scheme for vehicle wheel cleaning and other measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway. The CEMP shall broadly accord with BS 5228 - 1&2:2009 +A1:2014 (Code of practice for noise and vibration control on construction and open sites) and the WRS Demolition and Construction Guidance;
• details of site operative parking areas, material storage areas and the location of site operative facilities (offices, toilets etc);
• restrictions on burning; d. details in relation to the prevention of pollution of waterways;
• construction exclusion zones to prevent soil compaction in areas to be planted and remediation proposals for any soil compaction which does occur;
• a strategy for the handling and storage of topsoil;
• a management strategy and proposals for the minimisation of construction waste;
• details of any temporary construction accesses and their reinstatement;
• a scheme of temporary signage to direct construction related traffic to enter and exit the site; and
• a highway condition survey, timescale for re-inspections, and details of any reinstatement.

The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved in writing by the Local Planning Authority. The CEMP should generally comply with the requirements of Worcestershire Regulatory Services Code of Best Practice for Demolition and Construction Sites 1st Edition July 2011. Thereafter, the development shall be undertaken in accordance with the approved CEMP at all times during construction works.

Reason - To protect existing and new occupiers of residential areas from the unreasonable effects of noise, vibration, light and dust nuisance and to avoid and mitigate for any potential impact on protected species in accordance with Policies SWDP21 and 22 of the South Worcestershire Development Plan.


Before development commences, a detailed scheme for the site access works at Pershore Road and extension to Stewart Close, shall be submitted to and approved in writing by the Local Planning Authority (and Worcestershire County Council Highways). The development shall not be occupied or brought into use until the submitted scheme, which is broadly in accordance with drawing 210580-001 Rev B, subject to any necessary changes identified during the detailed design and Road Safety Audit processes, has been agreed in writing by the Local Planning Authority and has been implemented in full.

Reason: In the interests of achieving safe and suitable highway access for all users in accordance with the NPPF and Policy SWDP04 of the South Worcestershire Development Plan..


Before development commences, a lighting assessment undertaken in accordance with Worcestershire County Council’s Street Lighting Design Guide shall be submitted to and approved in writing by the Local Planning Authority (and Worcestershire County Council Highways). The development shall not be occupied until the submitted scheme has been agreed in writing by the Local Planning Authority and has been implemented in full.

Reason: In the interests of highway safety and to ensure the proposal complies with Policy SWDP04 of the South Worcestershire Development Plan.


The Development hereby approved shall not commence until a Construction Traffic Management Plan has been submitted to and approved in writing by the Local Planning Authority. This shall include but not be limited to the following:
• Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway;
• Details of site operative parking areas, material storage areas and the location of site operatives facilities (offices, toilets etc);
• The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring;
• Details of any temporary construction accesses and their reinstatement; and
• A highway condition survey, timescale for re-inspections, and details of any reinstatement.

The measures set out in the approved plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved by in writing by the local planning authority. Thereafter, the development shall be undertaken in accordance with the approved plan.

Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety and to ensure the proposal complies with Policy SWDP04 of the South Worcestershire Development Plan.


No works or development shall take place until a construction surface water management plan has been submitted to and approved in writing by the Local Planning Authority. The plan shall include how surface water will be managed during the construction phase, including site clearance, soil stripping and pond amendments. The plan shall include drawings of any temporary drainage systems, a timeline of construction and measures to mitigate the risk of pollution (including silt) of the water environment and offsite flood risk. The plan shall detail how the approved permanent surface water drainage system shall be remediated during the construction phase. The approved construction surface water management plan shall be implemented as soon as works start on site thereafter maintained during the full duration of the construction phase.

Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan.


Prior to the commencement of development hereby approved a landscape and ecological management plan (LEMP) shall be submitted to and agreed in writing by the Local Planning Authority. The content of the LEMP shall be based on the recommendations made in the Preliminary Ecological Appraisal BG23.116 dated April 2023 and Ecological Impact Assessment BG23.116.4 dated August 2023, both by Brindle & Green, the approved detailed Landscape Scheme and informed by the Biodiversity Impact Assessment BG23.116.2 Rev.2 dated March 2023 and associated metric calculations version 2, as well as additional off-site assessments and calculations. It shall be guided by the requirement to achieve a Biodiversity Net Gain, and shall maintain this after implementation. It shall include the following:
• Details (type and location) of wildlife boxes and refugia/hibernacula;
• Description and evaluation of the features to be managed;
• Ecological trends and constraints on site that might influence management.
• Aims and objectives of management;
• Appropriate management options for achieving aims and objectives;
• Prescriptions for management actions;
• Preparation of a work schedule, including an annual work plan capable of being rolled forward over a five-year period and for a minimum of 30 years thereafter;
• Details of the body or organisation responsible for implementation of the plan;
• On-going monitoring and remedial measures.
The plan shall also set out where the results of the monitoring show that conservation aims and objectives of the LEMP are not being met, how contingencies and/or remedial action identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme. The LEMP will be implemented in accordance with the approved details.

Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site, and to ensure the proposal harmonises with the surroundings in accordance with policies SWDP21, SWDP22 and SWDP25 of the South Worcestershire Development Plan 2016.


Prior to the commencement of development hereby permitted, an updated Landscape Planting Plan 2 (4082 201 rev F dated May 23) shall be submitted to and approved in writing by the Local Planning Authority. The update shall incorporate details of additional species and enhancements to the marginal pond plant mix to provide a wider range of plants suitable for Great Crested Newts. Thereafter, the development shall be undertaken in accordance with the approved scheme.

All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner.

Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.

Reason: To ensure the development contributes to the conservation and enhancement of biodiversity in accordance with policy SWDP22 of the South Worcestershire Development Plan” to the reason for that condition.


Prior to the commencement of development hereby approved a construction and ecological management plan for biodiversity (CEMPB) shall be submitted to and agreed in writing by the Local Planning Authority. It shall be guided by the requirement to achieve a Biodiversity Net Gain, and the development undertaken in accordance with the approved document and shall maintain this after implementation.

Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site, and to ensure the proposal harmonises with the surroundings in accordance with policies SWDP21, SWDP22 and SWDP25 of the South Worcestershire Development Plan 2016.


A "lighting design strategy for biodiversity" shall be submitted to and approved in writing by the local planning authority prior to the commencement of development. The strategy shall:
• Identify the areas/features on site that are particularly sensitive for bats and that are likely to cause disturbance in or around their breeding sites and resting places, or along important routes used to access key areas of their territory, for example, for foraging; and
• Show how and where external lighting will be installed (through the provision of appropriate lighting contour plans and technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb or prevent bats using their territory or having access to their breeding sites and resting places.

All external lighting shall be installed in accordance with the approved specifications and locations set out in the strategy, and these shall be maintained thereafter in accordance with the strategy. Under no circumstances should any other external lighting be installed without prior consent from the local planning authority.

Reason: To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and minimise impacts on protected species in accordance with Policy SWDP22


No part of the development shall be commenced, including any site clearance, until a Biodiversity Gain Plan (BGP) has been submitted to and approved by the planning authority. The plan shall be based on both on and off-site baseline assessments and habitat enhancements measured through either Defra metric 4.0 or the statutory metric, and shall thereafter be implemented in full prior to the occupation of the last dwelling.

Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity in accordance with SWDP policy 22 and NPPF paragraphs 180 and 186 (December 2023).


The development hereby approved shall not commence until a surface water drainage scheme for the proposed development has been submitted to, and approved in writing by, the Local Planning Authority. The scheme shall include details of surface water drainage measures, including for hardstanding areas, and shall conform with the non-statutory technical standards for SuDS (Defra 2015) and the Flood Risk Assessment and Water Management Statement (22248_FRA&WMS December 2023). If possible infiltration techniques are to be used and the plan shall include the details and results of field percolation tests. The scheme should include detailed design drawings for surface water drainage including drainage assets. Above ground attenuation SuDS should be prioritised and justified if not proposed and include run off treatment proposals for surface water drainage. Where the scheme includes communal surface water drainage assets proposals for dealing with the future maintenance of these assets should be included. The scheme should include proposals for informing future occupiers of the arrangements for maintenance of communal surface water drainage assets. The approved surface water drainage scheme shall be implemented prior to the first use of the development and thereafter maintained in accordance with the agreed scheme.

Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan.


Prior to any above ground construction, details of the sound reduction specifications to be used including the acoustic fencing Plots 14 and plots (flats 7-10) shall be submitted to and approved in writing by the local planning authority. The approved boundary treatment shall be completed before first occupation of the relevant properties and carried out in accordance with the approved details.

Reason: To protect the amenities of properties and to prevent unacceptable noise pollution to the detriment of human health contrary to policy SWDP31 of the South Worcestershire Development Plan.


Before the first occupation of the building(s) hereby permitted the first floor flank window(s) at plots 1, 25, 64 shall be non-opening and fitted with Pilkington Level 4 obscured glazing or equivalent and shall be permanently retained in that condition thereafter.

Reason: To protect the amenities of adjoining/nearby properties from unacceptable overlooking/loss of privacy and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan.


No dwelling hereby permitted shall be occupied until the parking spaces allocated to that property have been provided, as shown on the approved plans. Such parking spaces shall be kept clear of obstruction and retained only for the parking of vehicles in connection with the use of each property as a dwellinghouse.

Reason: To ensure that satisfactory provision is made for the parking of vehicles off the highway at all times in the interest of highway safety and to ensure the proposal complies with Policy SWDP04 of the South Worcestershire Development Plan.


Prior to the first occupation of any of the dwellings hereby approved, details of superfast broadband facilities or alternative solutions to serve the dwellings hereby approved shall be submitted to and approved in writing by the local planning authority. The submitted details shall include an implementation programme. The facilities shall be provided in accordance with the approved details.

Reason: To ensure the proposal incorporates satisfactory telecommunication facilities in line with policy SWDP26 of the South Worcestershire Development Plan 2016.


No dwelling hereby permitted shall be occupied until sheltered and secure cycle parking to comply with the Council’s adopted highway design guide has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only.

Reason: To comply with the Council’s parking standards and in accordance with Policy SWDP21 of the South Worcestershire Development Plan.


The development hereby approved shall not be occupied until the Applicant has submitted a Travel Plan in accordance with the County Council guidelines in writing to the Local Planning Authority that promotes sustainable forms of access to the development site and has been approved in writing by the Local Planning Authority. This plan will thereafter be implemented, monitored for a minimum of 5 years and shall be updated in agreement with Worcestershire County Council’s Travel Plan Officer and thereafter implemented as updated.

Reason: To reduce vehicle movements and promote sustainable access in accordance with Policy SWDP04 of the South Worcestershire Development Plan. .


The development shall be carried out using the materials shown on the materials plan.

Reason: To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan.


Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00 hrs Monday to Friday and 08.00 and 13.00 hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays.

Reason: To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan.


The Development hereby approved shall be carried out in accordance with drawing PL002 Rev H, subject to any minor modifications identified during the highways detailed design process which shall first be submitted to and approved in writing by the Local Planning Authority.

Reason: To define the permission and to ensure that the development meets the design quality and requirements of the Worcestershire Streetscape Design Guide.


All boundary fencing shall include mammal gates / gaps to ensure permeability for small mammals.

Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site, and to ensure the proposal harmonises with the surroundings in accordance with policies SWDP21, SWDP22 and SWDP25 of the South Worcestershire Development Plan 2016.


Details of the substation colour and any security fencing / landscaping shall be submitted to and approved in writing by the Local Planning Authority prior to its installation. The approved details shall be implemented thereafter.

Reason: To ensure that the appearance of the substation and the type of surrounding fencing / landscaping would minimise its impact on the street scene and in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.


All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the first occupation development, whichever is the sooner. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment.

Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.


Alteration of Highway to Provide New or Amended Vehicle Crossover
This permission does not authorise the Applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email [email protected]. The Applicant is solely responsible for all costs associated with construction of the access.

Section 278 Agreement Details
The granting of this planning permission does not remove any obligations on the applicant to undertake a technical design check of the proposed highway improvement works with the Highway Authority (Worcestershire County Council, WCC), nor does it confirm detailed design approval by the Highway Authority until the design check process has been concluded. Upon the satisfactory completion of the technical check the design would be suitable to allow relevant conditions imposed under this permission to be discharged but works to the public highway cannot take place until a legal agreement under Section 278 of the Highways Act 1980 has been entered into to allow the works and the applicant has complied with the requirements of the New Roads and Streetworks Act 1991 (NRSWA) and Traffic Management Act 2004. The person or organisation shall follow the necessary procedure by applying to WCC Streetworks Team for road space for a period to be agreed.
WCC normally use Section 278 to allow the developer to employ a contractor and for that contractor to work on the existing public highway in the same way as if WCC were conducting the works.

When any work is undertaken by a party acting on behalf of a developer on the existing adopted highway it will also be necessary to electronically provide notices to WCC (start date, location, workspace area) to allow these works to take place in accordance with NRSWA. Also, details regarding temporary traffic management controls for works in the public highway are to be submitted to WCC for approval using the online application process.

The applicant is urged to engage with WCC as early as possible to ensure that the approval process is started in a timely manner to achieve delivery of the highway works in accordance with the above-mentioned conditions.

The term “highway improvement works” includes, but is not limited to, a proposed junction or access arrangement, highway drainage, street lighting, structures in or adjacent to highway, and any necessary traffic regulation orders or statutory notice.

Section 38 Agreement Details
If it is the Applicant's intention to request the County Council, as Highway Authority, to adopt the proposed roadworks as maintainable at the public expense, then details of the layout and alignment, widths and levels of the proposed roadworks, which shall comply with any plans approved under this planning consent unless otherwise agreed in writing, together with all necessary drainage arrangements and run off calculations shall be submitted to the County Council's Network Control Manager, Worcestershire County Council, County Hall, Spetchley Road, Worcester, WR5 2NP. No works on the site of the development shall be commenced until these details have been approved by the County Council as Highway Authority and an Agreement under Section 38 of the Highways Act, 1980 entered into.

Drainage Details for Section 38
It is not known if the proposed roadworks can be satisfactorily drained to an adequate outfall. Unless adequate storm water disposal arrangements can be provided, the County Council, as Highway Authority, will be unable to adopt the proposed roadworks as public highways.
The Applicant is, therefore, advised to submit the engineering details referred to in this conditional approval to the County Council's County Network Control Manager, Worcestershire County Council, County Hall, Spetchley Road, Worcester, WR5 2NP at an early date to enable surface water disposal arrangements to be assessed.

No Drainage to Discharge to Highway
Drainage arrangements shall be provided to ensure that surface water from the driveway and/or vehicular turning area does not discharge onto the public highway. No drainage or effluent from the proposed development shall be allowed to discharge into any highway drain or over any part of the public highway.

Protection of Visibility Splays
The Applicant's attention is drawn to the need to ensure that the provision of the visibility splay(s) required by this consent is safeguarded in any sale of the application site or part(s) thereof.

Works Adjoining Highway
Any work involving the removal or disturbance of ground or structures supporting or abutting the publicly maintained highway should be carried out in accordance with details to be submitted to and approved in writing by the Highway Authority.

Temporary Direction Signs to Housing Developments
This consent does not authorise the erection of temporary direction signs on the public highway. Should the Applicant wish to direct traffic to the development site they should seek the consent of the Highway Authority. All temporary directional sign proposals should be submitted to the Network Control Manager, Worcestershire County Council, County Hall, Spetchley Road, Worcester, WR5 2NP. No signs should be erected without the consent of the Highway Authority.

Construction Environmental Management Plan (CEMP)
It is expected that contractors are registered with the Considerate Constructors scheme and comply with the code of conduct in full, but particular reference is made to "respecting the community" this says:

Constructors should give utmost consideration to their impact on neighbours and the public:
Informing, respecting and showing courtesy to those affected by the work;

Minimising the impact of deliveries, parking and work on the public highway;

Contributing to and supporting the local community and economy; and Working to create a positive and enduring impression and promoting the Code. he CEMP should clearly identify how the principal contractor will engage with the local community; this should be tailored to local circumstances. Contractors should also confirm how they will manage any local concerns and complaints and provide an agreed Service Level Agreement for responding to said issues.

Contractors should ensure that courtesy boards are provided, and information shared with the local community relating to the timing of operations and contact details for a site coordinator in the event of any difficulties.

This does not offer any relief to obligations under existing Legislation.

Travel Plan Requirements
Worcestershire County Council has published guidance on how it expects travel plans to be prepared, this guidance is freely available from the County Councils Travel Plans Officer. As part of this process the Applicant must register for Modeshift STARS Business and ensure that their targets have been uploaded so that progress on the implementation of the Travel Plan can be monitored. Worcestershire County Council can assist Applicants with this process should they need.
