The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

Reason: To define the permission.
All planting and seeding/turfing comprised in the submitted landscape scheme (Figure 05A), hereby approved, shall be carried out in the first planting season following the first occupation/use of the development. All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment. Any trees or plants that die, or are removed; or become seriously damaged or diseased within a period of five years from the completion of the planting, shall be replaced in the next planting season with others of similar size and species.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan 2016.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
The Development hereby approved shall not be brought into use until an electric vehicle charging facility has been provided in accordance with a specification which shall be submitted to and approved by the Local Planning Authority.
REASON: To encourage sustainable travel and healthy communities in accordance with SWDP4.
The visitor accommodation hereby approved shall be occupied for holiday purposes only and shall not be occupied as a person or persons’ sole, or main place of residence. Reason: The proposed unit/visitor accommodation would be situated in the open countryside, outside any defined settlement boundary where new residential development will be strictly controlled. The proposed unit/accommodation is only acceptable as a holiday let/ tourism development in accordance with policy SWDP35 of the South Worcestershire Development Plan. To grant permission without such a condition would be contrary to policy SWDP2 of the South Worcestershire Development Plan .
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Preliminary Ecological Appraisal report carried out by E-nigma Planning and Design dated November 2023 and submitted with this application. In particular:
- A further badger survey should be undertaken prior to the commencement of any development.
- Artificial lighting to be kept to a minimum with lanterns facing inwards towards the application site to prevent spillage.
- Programme of removal of non-native trees (specifically the conifers) and removal of scrub and bramble from underneath the orchard trees should be undertaken as part of the orchard restoration.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Prior to the commencement of the development hereby approved, a full badger survey should be carried out within the application site to ascertain whether badgers are present or utilise the site, and if so to provide recommendations on how the development should proceed to ensure their protection in accordance with the Protection of Badgers Act 1992. The development shall fully proceed in accordance with any such recommendations.
If evidence of badgers is found, Warwickshire Museum Ecology Unit, the Badger Group, or Natural England should be contacted immediately Badgers and their sets are protected under the 1992 Badgers Act, and it is illegal to carry out work which may disturb badgers without a licence from English Nature.
Reason: To ensure that nationally protected species and their habitats are conserved in line with their status, in accordance with SWDP22.
