The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan, 2016 and the National Planning Policy Framework, 2023.
Any static caravan positioned on the site shall meet the definition of a caravan as set out in section 29 of the Caravan Sites and Control of Development Act 1960 and section 13 of the Caravan Sites Act 1968. There shall be no more than 11 static caravans/holiday lodges on the application site at any one time. The caravans shall be positioned on the site as shown on the approved plan reference 882.2/103B entitled ‘Landscape Layout’.
Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan, 2016 and the National Planning Policy Framework.
Notwithstanding the details submitted, prior to the commencement of development, a detailed schedule of external materials for the caravans to be sited shall first be submitted to and approved in writing by the Local Planning Authority. All caravans including replacements shall thereafter accord with the approved schedule.
Reason: To protect the character and appearance of the area and the local landscape in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan, 2016.
Prior to the commencement of the development hereby approved is commenced details of any hardstandings, which shall be constructed in permeable materials, to be laid on site shall be submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure that any hardstandings on the site are constructed in permeable materials in order to ensure the efficient disposal of surface water from the site in accordance with Policy SWDP29 of the South Worcestershire Development Plan, 2016
No development shall take place (including demolition, ground works, vegetation clearance) until a Construction Environmental Management Plan for biodiversity(CEMP Biodiversity) which shall be based on the findings of the Preliminary Ecological Appraisal and preliminary Bat Roost Assessment, March 2024 (Arbtech) has been submitted to and approved in writing by the Local Planning Authority. The CEMP (Biodiversity) shall include the following:-
a) Risk assessment of potentially damaging construction activities.
b) Identification of “biodiversity protection zones”.
c) Practical measures (both physical measures and sensitive working practices) to avoid or reduce impacts during construction (may be provided as a set of method statements).
d) The location and timing of sensitive works to avoid harm to biodiversity features.
e) The times during construction when specialist ecologists need to be present on site to oversee works.
f) Responsible persons and lines of communication.
g) The role and responsibilities on site of an ecological clerk of works or similarly competent person.
h) Use of protective fences, exclusion barriers and warning signs.
The approved CEMP shall be adhered to and implemented throughout the construction period strictly in accordance with the approved details.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and to ensure compliance with the Wildlife and Countryside Act 1981 and the Conservation of Habitats and Species Regulations 2017.
No development shall take place (including vegetation/site clearance) until a Precautionary Working Method Statement (PWMS) for reptiles, amphibians, and great crested newts has been submitted to and approved in writing by the Local Planning Authority. The approved PWMS shall be implemented in full according to the specified timescales, unless otherwise agreed in writing by the local planning authority.
Reason: To ensure the development has regards to Protected Species in accordance with Policy SWDP22 of the South Worcestershire Development Plan, 2016.
Notwithstanding the submitted drainage details, no development shall commence until a full drainage strategy including detailed design drawings and calculations for surface water and foul water drainage based on infiltration testing and the use of package sewage treatment plants has been submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved details and the approved facilities shall be retained operational.
Reason: To ensure that the site is adequately drained in accordance with paragraph 167 of the NPPF and policy SWDP29 of the South Worcestershire Development Plan, to reduce the risk of creating or exacerbating a local flooding problem and to minimise the risk of pollution.
Development shall not commence until evidence has been submitted to and approved in writing by the Local Planning Authority (LPA) demonstrating that a conservation covenant or a Section 106 agreement has been entered into to provide and control the long-term management, monitoring, and enhancement of biodiversity at the off-site habitat located at Martley Habitat Bank (MALV2301). The conservation covenant or section 106 agreement shall ensure the delivery of the required biodiversity units for a minimum period of 30 years from completion of the habitat enhancement works.
The submitted evidence shall include: a copy of the conservation covenant or section 106 agreement demonstrating that the off-site habitat is managed in accordance with the approved Biodiversity Gain Plan.
Reason: To ensure that the development provides adequate biodiversity compensation and enhancement in accordance with Policy SWDP22 of the South Worcestershire Development Plan, 2016, Section 15 of the NPPF, 2023 together with the objectives of the Environment Act, 2021.
The development hereby permitted shall be carried out in accordance with the mitigation and recommendations set out within the report ‘Preliminary Ecological Appraisal and preliminary Bat Roost Assessment’ dated March 2024 (Arbtech).
Reason: To ensure safeguarding of protected species and biodiversity and to ensure that the development provides for adequate biodiversity enhancement in accordance with Policy SWDP 22 of the South Worcestershire Development Plan, 2016.
Prior to the commencement of the development hereby approved, the existing trees, shrubs and hedges on the site shall be protected by fencing constructed in accordance with BS 5837:2012 (trees in relation to design, demolition and construction - recommendations). These protection measures will be retained throughout the development of the site in the approved positions.
Reason: To protect the existing trees and hedges to be retained on the site during construction work and to preserve the amenities of the locality in accordance with policies SWDP21 and SWDP22 of the South Worcestershire Development Plan, 2016.
Before the commencement of construction works on the development hereby permitted a detailed landscaping scheme based on plan reference 882.2/1038 entitled ‘Landscape Layout’ shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:-
(i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread.
(ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas.
(iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants.
(iv) a written specification outlining cultivation and other operations associated with plant and grass establishment.
(v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner.
The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.
Reason: To ensure appropriate planting so that the development is not visually intrusive in the landscape and that it contributes to the conservation and enhancement of biodiversity within the site and the wider area, in accordance with Policies SWDP21, SWDP22, SWDP25 and SWDP36 of the South Worcestershire Development Plan, 2016.
Before the first use/occupation of the development hereby permitted a schedule of landscape maintenance for a minimum period of 20 years has been submitted to and approved in writing by the local planning authority. The schedule shall include details of the arrangements for its implementation, long-term design objectives, management responsibilities and maintenance schedules for all landscape areas (excluding domestic gardens). The approved landscape maintenance schedule shall be fully implemented. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan, 2016.
The caravans hereby permitted shall not be occupied until access, parking and turning facilities have been provided within the development site in accordance with Plan Reference 882.2/103B. The approved parking spaces shall thereafter be retained available for these purposes.
Reason: In the interests of highway safety to ensure the free flow of traffic and to ensure the provision of adequate parking in accordance with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan, 2016 and the Worcestershire Streetscapes Design Guide, 2022.
The caravans hereby permitted shall not be occupied until secure cycle parking provision for visitors, to comply with the County Council’s adopted Streetscape Design Guide, has been provided in accordance with details first submitted to and approved in writing by the Local Planning Authority. The approved cycle parking facilities shall thereafter be retained available for this purpose.
Reason: To comply with the cycle standards set out in the Streetscape Design Guide for Worcestershire and in the interest of sustainability.
The caravans within the caravan park extension hereby approved shall be occupied for holiday purposes only and shall not be occupied as a person or persons’ sole, or main place of residence.
Reason: The caravan park is situated in the open countryside, outside any defined settlement boundary where new residential development will be strictly controlled. To grant permission without such a condition would be contrary to policy SWDP2 of the South Worcestershire Development Plan, 2016.
The owners/operators of the holiday/visitor accommodation hereby approved shall maintain an up-to-date register of the names of all guests/occupiers of each caravan. This register shall be made available within one calendar month of a written request by the Local Planning Authority.
Reason: The proposed unit/visitor accommodation would be situated in the open countryside, outside any defined settlement boundary where new residential development will be strictly controlled. The proposed unit/accommodation is only acceptable as tourism development in accordance with Policy SWDP35 and SWDP36 of the South Worcestershire Development Plan, 2016. To grant permission without such a condition would be contrary to Policy SWDP2 of the South Worcestershire Development Plan, 2016.
Prior to installation, a lighting plan for the operation phase of development, shall be submitted to and approved in writing by the Local Planning Authority. All lighting should be designed in accordance with Bat Conservation Trust / Institution of Lighting Professionals Guidance Note 08/18 Bats and artificial lighting in the UK. Submitted lighting plans should be accompanied by contour diagrams that demonstrates minimal levels of lighting on receptor habitats, including trees and hedges. Development shall be carried out in accordance with the approved details and retained thereafter.
Reason: To ensure adequate protection to biodiversity in accordance with Policy SWDP 22 of the South Worcestershire Development Plan, 2016.
