The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.


No works or development shall take place until a drainage scheme prioritising surface water discharge by infiltration, in accordance with the drainage hierarchy (Building regulations: H3 - Drainage and Waste disposal (2015); National standards for sustainable drainage systems (2025)) for the proposed development has been submitted to and approved in writing by the Local Planning Authority. The scheme shall maximise soakaway SuDS potential for the development in its entirety and shall be informed by further detailed geotechnical ground investigations, including groundwater monitoring, in accordance with BRE Digest 365, or such other guidance as may be agreed in writing by the Local Planning Authority. The results of the tests shall be submitted to and agreed in writing by the Local Planning Authority and the agreed recommendations shall be implemented in full prior to the first use of the development hereby approved. The scheme shall give lowest priority to discharging surface water by a sewer. If discharging to a sewer forms part of the drainage strategy, the design shall be in accordance with the Flood Risk Assessment (27836-FLD-0101 Rev D) and will require justification and evidence of inadequate infiltration for the development, to be submitted to and approved by the Local Planning Authority.

Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework.


No works or development shall take place until the existing ditch network has been remediated and maintained, including evidence of the condition, any defects, damage or obstructions to flow from any outfall and pipework serving the southern ditch. A scheme including a schedule for any remediation, restoration or cleaning of any outfall and pipework will be submitted to and approved by the Local Planning Authority.

Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework.


No development shall take place until an Ecological Mitigation, Compensation and Enhancement Scheme (EMCES) has been drawn up by a suitably-qualified ecologist and submitted to and approved in writing by the local planning authority. The scheme shall be based on the recommendations made in the Preliminary Ecological Appraisal report by Betts Ecology, dated October 2023 and shall include:

- Sufficient protective buffers of retained trees and important vegetation where necessary;
- Adoption of a sensitive lighting scheme;
- Reasonable Avoidance Measures for nesting birds;
- Precautionary Working Measures for Herptiles, Badgers, Hedgehogs and other mammals;
- Details on the number and locations of bat and bird boxes on proposed dwellings and retained trees;
- Details on hibernacula as enhancements for amphibians and reptiles;
- An Implementation Timetable.

The works shall thereafter be carried out in accordance with the approved details and timetable.

Reason – To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with paragraphs 187 and 193 of the National Planning Policy Framework (NPPF) and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and the relevant aims and objectives of the National Planning Policy Framework.


The development shall not commence until a Habitat Management and Monitoring Plan (HMMP) has been prepared in accordance with the approved Biodiversity Gain Plan and approved landscaping scheme and has been submitted to and approved in writing by the local planning authority. The HMMP will be based on the recommendations made in the Biodiversity Net Gain Calculation letter by Betts Ecology, dated September 2024 and shall include:

- A non-technical summary;
- The roles and responsibilities of the people or organisation(s) delivering the HMMP;
- The planned habitat creation and enhancement works to create or improve habitat to achieve biodiversity net gain in accordance with the approved Biodiversity Gain Plan;
- The management measures to maintain habitat in accordance with the approved Biodiversity Gain Plan for a period of 30 years from the completion of the development; and
- The monitoring methodology and frequency in respect of the created or enhanced habitat to be submitted to the local planning authority. Notice in writing shall be given to the council when the habitat creation and enhancement works as set out in the HMMP have been completed.

The created and enhanced habitat specified in the approved HMMP shall thereafter be managed and maintained in accordance with the approved HMMP.
Monitoring reports shall be submitted to the local planning authority in writing in accordance with the methodology and frequency specified in the approved HMMP.
The plan shall also set out where the results of the monitoring show that conservation aims and objectives of the HMMP are not being met, how contingencies and/or remedial action are identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme.

Reason – To ensure that the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990 and SWDP 22 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.


Prior to the commencement of development hereby permitted, a Lighting Design Strategy for Biodiversity shall be submitted to and approved in writing by the local planning authority. The strategy shall be based on Guidance Note 08/23. Bats and Artificial Lighting at Night, by the Bat Conservation Trust and ILP and shall:

- Identify those areas/features on site that are particularly sensitive for nocturnal wildlife and that are likely to cause disturbance in or around their breeding sites and resting places or along important routes used to access key areas of their territory, for example, for foraging; and
- Show how and where external lighting will be installed and impacts of internal light spill (through the provision of appropriate lighting contour plans and technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb or prevent nocturnal animals from using their territory or having access to their breeding sites and resting places. This will include the provision of dark corridor conditions for retained trees, hedgerows and other commuting routes.

All lighting shall be installed in accordance with the specifications and locations set out in the strategy, and these shall be maintained thereafter in accordance with the strategy. Under no circumstances shall any other external lighting be installed without prior consent from the local planning authority.
Reason – To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and to minimise impacts on protected species in accordance with SWDP 22 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.


No works or development shall take place until a construction surface water management plan has been submitted to and approved in writing by the Local Planning Authority. The plan shall include how surface water will be managed during the construction phase, including site clearance, soil stripping and basin amendments. The plan shall include drawings of any temporary drainage systems, a timeline of construction and measures to mitigate the risk of pollution (including silt) of the water environment and offsite flood risk. The plan shall detail how the approved permanent surface water drainage system shall be remediated during the construction phase. The approved construction surface water management plan shall be implemented as soon as works start on site thereafter maintained during the full duration of the construction phase.

Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework.


No works in connection with site drainage shall commence until a scheme for a surface water drainage strategy for the proposed development has been submitted to and approved in writing by the Local Planning Authority. The strategy shall include details of surface water drainage measures, including for hardstanding areas, and shall conform with the National standards for sustainable drainage systems (2025), and shall include the results of an assessment into the potential of disposing of surface water by means of a sustainable drainage system (SuDS). The scheme shall provide detailed design drawings for all drainage assets and should include run off treatment proposals for surface water drainage. Exceedance flows should not be directed to property or private land. Where the scheme includes communal surface water drainage assets, proposals for dealing with the future maintenance of these assets should be included. The scheme should include proposals for informing future homeowners or occupiers of the arrangements for maintenance of communal and private surface water drainage assets. The approved surface water drainage scheme shall be implemented prior to the first use of the development and thereafter maintained in accordance with the agreed scheme.

Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework.


The Development hereby approved shall not commence until a Construction Traffic Management Plan has been submitted to and approved in writing by the Local Planning Authority. This shall include but not be limited to the following:-
• Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway;
• Details of site operative parking areas, material storage areas and the location of site operatives’ facilities (offices, toilets etc);
• The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring.
• Details of any temporary construction accesses and their reinstatement.
• A highway condition survey, timescale for re-inspections, and details of any reinstatement.

The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved by in writing by the local planning authority.

REASON: To ensure the provision of adequate on-site facilities and in the interests of highway safety and accord with policy SWDP4 of the South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework.


(A) No development shall take place until a programme of archaeological work, including a Written Scheme of Investigation, has been submitted to and approved by the local planning authority in writing. The scheme shall include an assessment of significance and research questions; and:
1) The programme and methodology of site investigation and recording.
2) The programme for post investigation assessment.
3) Provision to be made for analysis of the site investigation and recording.
4) Provision to be made for publication and dissemination of the analysis and records of the site investigation.
5) Provision to be made for archive deposition of the analysis and records of the site investigation.
6) Nomination of a competent person or persons/organisation to undertake the works set out within the Written Scheme of Investigation.

(B) The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition (A) and the provision made for analysis, publication and dissemination of results and archive deposition has been secured.

Reason: In accordance with the requirements of paragraphs 207 and 218 of the National Planning Policy Framework (as amended) and SWDP 6 & 24 of the South Worcestershire Development Plan 2016. and the relevant aims and objectives of the National Planning Policy Framework.


Prior to the commencement of development hereby approved a landscape and ecological management plan (LEMP) shall be submitted to and agreed in writing by the Local Planning Authority. The content of the LEMP shall include the following:

a. Description and evaluation of the features to be managed;
b. Ecological trends and constraints on site that might influence management.
c. Aims and objectives of management;
d. Appropriate management options for achieving aims and objectives;
e. Prescriptions for management actions;
f. Preparation of a work schedule, including an annual work plan capable of being rolled forward over a five-year period and for a minimum of 30 years thereafter;
g. Details of the body or organisation responsible for implementation of the plan;
h. On-going monitoring and remedial measures.

The plan shall also set out where the results of the monitoring show that conservation aims and objectives of the LEMP are not being met, how contingencies and/or remedial action identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme.

The LEMP will be implemented in accordance with the approved details.

Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site, and to ensure the proposal harmonises with the surroundings in accordance with policies SWDP21, SWDP22 and SWDP25 of the South
Worcestershire Development Plan 2016 and the aims and objectives of the National Planning Policy Framework


Before the commencement of construction works on the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. (iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. (v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.

Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework.


Prior to the commencement of the development, full details of a scheme for the provision of foul drainage for the site shall be submitted to and approved in writing by the Local Planning Authority. These details shall: - Include the design of all on and off-site foul sewerage infrastructure, the diameters of proposed pipes and the capacity of any on or off-site storage; - Include a timetable and programme for the provision of the foul sewerage infrastructure; and - Demonstrate that, where connection to a public sewer is proposed, the additional foul sewerage discharge can be accommodated within the public sewer system without increasing the risk of flooding or backing up of the existing system on the site or elsewhere. The development shall be carried out in accordance with the approved details and the approved timetable and programme.

Reason: To ensure the development is served by satisfactory arrangements for the disposal of foul sewage and to ensure that the development does not increase the risk of flooding. These details are required prior to the commencement of the development as they form an intrinsic part of the proposal, the approval of which cannot be disaggregated from the carrying out of the rest of the development, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework.


The construction work on the buildings hereby approved shall not be commenced until the precise floor slab levels of each new building, relative to the existing development on the boundary of the application site have been submitted to and approved in writing by the local planning authority. Thereafter the new buildings shall be constructed at the approved floor slab levels.

Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework.


No building operations hereby permitted shall commence until details of the materials to be used in the construction of the external surfaces of the dwellings hereby permitted have been submitted to and approved in writing by the local planning authority. The development shall be carried out using the materials as approved.

Reason - To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework


Finished floor levels within the development shall be set no lower than 600 mm in areas modelled at risk of surface water flooding.

Reason: To ensure the proposed development is not at risk of flooding in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework.


The Development hereby permitted shall not be first occupied until sheltered and secure cycle parking to comply with the Council’s adopted highway design guide has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only.

REASON: To encourage journeys to be taken by means other than the private car, promote sustainable active travel, and comply with the Council’s parking standards and Policies SWDP1, SWDP4 and SWDP21, and the relevant aims and objectives of the National Planning Policy Framework.


The Development hereby approved shall not be first occupied until the Applicant has submitted to and had approval in writing from the Local Planning Authority a residential Travel Welcome Pack promoting sustainable forms of access to the development. The pack shall be provided to each resident at the point of occupation.

REASON: To ensure residents of the development site are offered a genuine choice of sustainable travel modes and to promote sustainable access to the development site to accord with policy SWDP4 of the South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework


Prior to the occupation of any part of the development hereby permitted details of renewable or low carbon energy generating facilities to be incorporated as part of the development shall be submitted to and approved in writing by the local planning authority. The details shall demonstrate that at least 10% of the predicted energy requirements of the development will be met through the use of renewable/low carbon energy generating facilities. The approved facilities shall be provided prior to any part of the development hereby permitted being first occupied or in accordance with a timetable submitted to and approved by the local planning authority as part of the details required by this condition.

Reason: To ensure the proposed development includes sufficient renewable/low carbon energy generating facilities to comply with Policy 27 of the South Worcestershire Development Plan 2016 and the aims and objectives of the National Planning Policy Framework.


Prior to the first occupation of the development hereby permitted, a timetable for the provision of the public open space/play area as shown on the approved plans shall be submitted to and approved in writing by the local planning authority. The development shall be carried out in accordance with the approved timetable.

Reason: To ensure the development incorporates adequate green infrastructure and outdoor recreation space in accordance with policies SWDP5 and SWDP39 of the South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework


Prior to the first occupation of the dwellings hereby permitted, details of water efficiency measures to demonstrate that the daily non-recycled water use per person will not exceed 110 litres per day shall be submitted to and approved in writing by the Local Planning Authority. The development shall be implemented in accordance with he approved details.

Reason: To demonstrate effective management of water in accordance with policy SWDP 30 and the aims and objectives of the National Planning Policy Framework (NPPF).


Prior to the first occupation of any of the dwellings hereby approved, details of superfast broadband facilities or alternative solutions to serve the dwellings hereby approved shall be submitted to and approved in writing by the local planning authority. The submitted details shall include an implementation programme. The facilities shall be provided in accordance with the approved details.

Reason: To ensure the proposal incorporates satisfactory telecommunication facilities in line with policy SWDP26 of the South Worcestershire Development Plan 2016.


Temporary fencing for the protection of all retained trees/hedges on site and trees outside the site whose Root Protection Areas fall within the site shall be erected in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction) before development of any type commences, including site clearance, demolition, materials delivery, vehicular movement and erection of site huts. Any alternative fencing type or position not strictly in accordance with BS 5837 (2012) must be agreed in writing by the local planning authority prior to the commencement of development. This protective fencing shall remain in place until the completion of development or unless otherwise agreed in writing with the local planning authority. Nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area without the previous written consent of the local planning authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge.

Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. This is in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework


Details of the final Boundary Treatments shall be submitted to and approved in writing by the local planning authority. All boundary fencing shall include mammal gates/gaps to ensure permeability for small mammals. The agreed details shall be implemented thereafter.

Reason – To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and to ensure that the proposal harmonises with the surroundings in accordance with SWDP 21, SWDP 22 and SWDP 25 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.


The approved Biodiversity Gain Plan required by paragraph 13 of Schedule 7A of the Town and Country Planning Act 1990 shall be implemented in strict accordance with the details and timescale agreed within the plan and maintained thereafter in accordance with the approved Habitat Management and Monitoring Plan (HMMP).

Reason – To ensure that the proposed development delivers a biodiversity net gain in accordance with Schedule 7A of the Town and Country Planning Act 1990 and SWDP 22 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.


The applicant must fully investigate the possible connection of the southern ditch to a culvert running west into the village. If there is a culvert, the applicant will need to re-consider where surface water will discharge to.

Notwithstanding the details already submitted, there is the issue with the southern ditch being connected to the northern ditch. This can be covered within the conditions already suggested.

Please note that any proposals to alter existing, or construct new, culverts or carry out works in or on an ordinary watercourse will need Land Drainage Consent under s.23; Land Drainage Act 1991 from SWLDP. Such consent will need to be granted prior to works commencing on site as consent cannot be granted retrospectively. Failure to comply may result in enforcement action being taken by the Lead Local Flood Authority, Worcestershire County Council, under the Act. SWLDP may also exercise powers to require works for maintaining flow of a watercourse where appropriate under s.25 of the Act where the proper flow of water is impeded.

The applicant should be aware that polluting the nearby watercourse, for instance by allowing the discharge of sediment rich runoff from the construction site, might constitute an environmental offence. The applicant is expected to fully assess the risks from all pollution sources and pathways and take sufficient precautionary measures to mitigate these risks for this development.


Alteration of highway
This permission does not authorise the Applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email [email protected]. The applicant is solely responsible for all costs associated with construction of the access.

Section 38 Agreement Details
If it is the Applicant's intention to request the County Council, as Highway Authority, to adopt the proposed roadworks as maintainable at the public expense, then details of the layout and alignment, widths and levels of the proposed roadworks, which shall comply with any plans approved under this planning consent unless otherwise agreed in writing, together with all necessary drainage arrangements and run off calculations shall be submitted to the County Council's Network Control Manager, Worcestershire County Council, County Hall, Spetchley Road, Worcester, WR5 2NP. No works on the site of the development shall be commenced until these details have been approved by the County Council, as Highway Authority, and an Agreement under Section 38 of the Highways Act, 1980, entered into.

Works Adjoining Highway
Any work involving the removal or disturbance of ground or structures supporting or abutting the publicly maintained highway should be carried out in accordance with details to be submitted to and approved in writing by the Highway Authority.

Temporary Direction Signs to Housing Developments
This consent does not authorise the erection of temporary direction signs on the public highway. Should the applicant wish to direct traffic to the development site they should seek the consent of the Highway Authority. All temporary directional sign proposals should be submitted to the Network Control Manager, Worcestershire County Council, County Hall, Spetchley Road, Worcester, WR5 2NP. No signs should be erected without the consent of the Highway Authority.

Construction Traffic Management Plan (CEMP)
It is expected that contractors are registered with the Considerate Constructors scheme and comply with the code of conduct in full, but particular reference is made to "respecting the community" this says:-
Constructors should give utmost consideration to their impact on neighbours and the public
•Informing, respecting and showing courtesy to those affected by the work.
•Minimising the impact of deliveries, parking and work on the public highway.
•Contributing to and supporting the local community and economy.
•Working to create a positive and enduring impression and promoting the Code.

The CTMP should clearly identify how the principal contractor will engage with the local community, this should be tailored to local circumstances. Contractors should also confirm how they will manage any local concerns and complaints and provide an agreed Service Level Agreement for responding to said issues. Contractors should ensure that courtesy boards are provided and information shared with the local community relating to the timing of operations and contact details for a site coordinator in the event of any difficulties.
This does not offer any relief to obligations under existing Legislation.


The effect of paragraph 13 of Schedule 7A of the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition (“the biodiversity gain condition”) that development may not begin unless:

- A Biodiversity Gain Plan has been submitted to the local planning authority; and
- The planning authority has approved the plan.

Subject to Paragraph 14(2) of Schedule 7A of the Town and Country Planning Act 1990, the Biodiversity Gain Plan must include:

- Information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the on-site habitat and any other habitat;
- The pre-development biodiversity value of the on-site habitat;
- The post-development biodiversity value of the on-site habitat.
