The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
The development hereby approved shall be implemented in accordance with the details submitted with the application and shown on the following listed plans and drawings ('the approved plans') unless other conditions of this Decision Notice dictate otherwise -
Site Location Plan reference 374-24-PL001by Petersen-Jones Architects Ltd dated June 2024; and
Sweet Pea (converted shipping container) Proposed Plan reference 374-24-PL103 by Petersen-Jones Architects Ltd dated January 2025; and
Bluebell Cabin (converted shipping container) Proposed Plan reference 374-24-PL102C by Petersen-Jones Architects Ltd dated June 2024; and

Reason: In order to define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
No more than TWO cabin units classed as caravans, as defined in the Caravan Sites and Control of Development Act 1960 and the Caravan Sites Act 1968 shall be stationed on the application site at any time.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and relevant aims and objectives of the National Planning Policy Framework (NPPF), and also to accord with SWDP 36 in securing appropriate quantum of development in relation to visual unobtrusiveness and visual amenity, and apportioned appropriate levels of landscaping. In addition to secure adequate provision of site infrastructure including foul drainage, water supply and utilities, sewage pump out and waste disposal, and relevant aims and objectives of the NPPF as updated.
No person or group of persons shall occupy the holiday accommodation hereby permitted for more than 28 days consecutive days at a time and no same person or group of persons shall occupy the accommodation for more than 156 days in any one calendar year. The owners/operators of the site shall maintain an up-to-date register of the names of all occupiers of the accommodation and of their main home address (i.e. place of residence) and shall make this information available at all reasonable times to the Local Planning Authority.
Reason: To ensure that the development hereby permitted is used for the specific use applied for, to prevent unrestricted residential development, in the interests of highway safety and the amenity of the location and general environment, and in the interests of ensuring a sustainable pattern of development, in accordance with polices of the South Worcestershire Development Plan policies SWDP1, SWDP2, SWDP4, SWDP6, SWDP21, SWDP24, SWDP34, SWDP35, SWDP36, and the relevant objectives and principles of the National Planning Policy Framework.
The holiday cabins/caravans hereby permitted shall not be first occupied precise details of the floor levels of each cabin/caravan relative to the existing ground levels have been submitted to and approved in writing by the local planning authority. Thereafter the approved floor levels shall be maintained for the lifetime of the development.
Reason - To ensure the proposed development is not affected by flooding / surface water flooding in accordance with SWDP policies SWDP 28 and SWDP 29 of South Worcestershire Development Plan, and relevant aims and objectives of the National Planning Policy Framework.
Before the first use/occupation of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. (iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. (v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.
Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter.
The cabins need to be sited at least 300m above ground level on concrete breeze blocks. This would ensure that the units would not be impacted upon by surface water run off. The units are all to be temporary structures, and remain temporary units which can be removed from the site easily.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with SWDP Policies 28 and 29 of the adopted South Worcestershire Development Plan 2016 and relevant aims and objectives of the National Planning Policy Framework.
Before the development hereby permitted is first occupied/used, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site and thereafter used in accordance with those approved details. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site.
Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area or its amenity, in accordance with policies SWDP1, SWDP21 and SWDP25 of South Worcestershire Development Plan., and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall not be occupied/first used until full details of all foul and surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter.
Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- providing pre-application advice; - seeking further information following receipt of the application; - considering the imposition of conditions . In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
The applicant will need to contact the Council's Engineering Section to obtain Ordinary Watercourse Land Drainage Consent for the proposed culvert beneath the proposed access from Pear Tree Lane.
