The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents:
• Block and location plans 873-005B Rev 0 dated 19.06.2025 (insofar as it relates to the building subject of this application);
• Elevations 873-004 dated 29.07.24;
• Flood Plans 873-003 dated 29.07.24;
• Design and Access Statement;
• Energy Statement.
Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Temporary fencing for the protection of all retained trees/hedges on site and trees outside the site whose Root Protection Areas fall within the site shall be erected in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction) before development of any type commences, including site clearance, demolition, materials delivery, vehicular movement and erection of site huts.
Any alternative fencing type or position not strictly in accordance with BS 5837 (2012) must be agreed in writing by the local planning authority prior to the commencement of development.
This protective fencing shall remain in place until the completion of development or unless otherwise agreed in writing with the local planning authority. Nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area without the previous written consent of the local planning authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge.
Reason: To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. In accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
No building operations above ground level hereby permitted shall commence until details of the materials to be used in the construction of the external surfaces of the proposed building hereby permitted have been submitted to and approved in writing by the local planning authority. The details to be submitted shall include: type, colour, texture and finish of the proposed cladding for the roof and walls.
The development shall be carried out using the materials as approved.
Reason: To ensure that the new materials are in keeping with the surroundings and to represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
No part of the building hereby approved shall be occupied until details of the design, implementation, maintenance and management of sustainable urban drainage/surface water drainage works have been submitted to and approved in writing by the local planning authority. The submitted details shall:
a) provide information about the design storm period and intensity, the method employed to delay and control the surface water discharged from the site and the measures taken to prevent pollution of the receiving groundwater and/or surface waters;
b) include a timetable for its implementation; and
c) provide a management and maintenance plan for the lifetime of the development which shall include the arrangements for adoption by any public authority or statutory undertaker and any other arrangements to secure the operation of the scheme throughout its lifetime.
The development shall be carried out, and the drainage maintained/managed, in accordance with the approved details.
Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Prior to the occupation of any part of the development hereby permitted details of renewable or low carbon energy generating facilities to be incorporated as part of the development shall be submitted to and approved in writing by the local planning authority. The details shall demonstrate that at least 10% of the predicted energy requirements of the development will be met through the use of renewable/low carbon energy generating facilities. The approved facilities shall be provided prior to any part of the development hereby permitted being first occupied or in accordance with a timetable submitted to and approved by the local planning authority as part of the details required by this condition. Reason: To ensure the proposed development includes sufficient renewable/low carbon energy generating facilities to comply with Policy SWDP 27 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby approved shall not be first occupied until sheltered and secure cycle parking to comply with the Council’s adopted cycle parking standards has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only.
Reason: To facilitate and encourage non motor vehicle based travel, comply with the Council’s parking standards in accordance with the Streetscapes Design Guide (2022) and to comply with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan, and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby approved shall not be occupied until measures to ensure pedestrian safety for those using the ‘safe pedestrian walkways’ as shown on the Block and Location Plan (reference: 873-005B), have been submitted and approved in writing by the Local Planning Authority. The safety measures shall thereafter be implemented in full and thereafter the retained for the lifetime of the development.
Reason: To ensure that a pedestrian route through the site is maintained throughout the site to ensure that the development provides a safe environment having regard to Policy SWDP 21 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby approved shall not be occupied until details of an Employment Travel Plan, promoting sustainable forms of transport is made available to employees working at the development hereby approved, has been submitted to and had approval in writing from the Local Planning Authority.
Reason: To ensure occupiers of the development site are offered a genuine choice of sustainable travel modes and to promote sustainable access to the development site in accordance with policy SWDP 4 of the South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended), the unit hereby approved shall be solely used for purposes falling within class B8 (storage and distribution) and no mezzanine floors shall be added.
Reason: To ensure appropriate definition and control of the development hereby permitted for clarity and the avoidance of doubt, to ensure the development provides appropriate employment uses and to ensure highway safety and sufficient parking provision, in accordance with Policies SWDP2, SWDP3, SWDP14 and SWDP21 of the South Worcestershire Development Plan. and the relevant aims and objectives of the National Planning Policy Framework.
Hereford and Worcester Fire Service recommend that consideration of access for fire appliances to the new Warehouse building and the sufficiency and availability of water provision should be considered at an early stage.
Fire Service Vehicle access must generally comply with the requirements of ADB 2019 Vol. 2 B5, section 15 & Table 15.1.
In particular, there should be Fire Service vehicle access for a Fire Appliance to: 15% of the perimeter of the building, OR
Within 45 metres of every point of the footprint of the building.
Access roads must be in accordance with ADB 2019 Vol. 1 Table 15.2.
Water for firefighting purposes should be provided in accordance with: ADB 2019 Vol. 2 B5, section 16. Water may be provided from Fire Mains or Static Water supplies.
The effect of paragraph 13 of Schedule 7A of the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition (the biodiversity gain condition) that development may not begin unless:
• A Biodiversity Gain Plan has been submitted to the Local Planning Authority; and
• The planning authority has approved the plan.
Subject to paragraph 14(2) of Schedule 7A of the Town and Country Planning Act 1990, the biodiversity gain plan must include:
• Information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the on-site habitat and any other habitat;
• The pre-development biodiversity value of the on-site habitat;
• The post-development biodiversity value of the on-site habitat.

Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant by seeking further information following receipt of the application, seeking amendments to the proposed development following receipt of the application and by considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
It is recommended that the design includes flood resilience measures by ensuring that the in electrical services in the building at a high level so that plugs are located above possible flood levels.
