Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. Reason: To ensure that the proposal continues to operate in accordance with the details submitted and approved and to accord with the relevant Policies in the SWDP and elements of the National Planning Policy Framework.
The operation of the solar farm for electricity generation shall be discontinued on or before 41 years from the date of completion of the installation which is deemed to be the 22nd March 2016.
Reason: To ensure that the proposal continues to operate in accordance with the details submitted and approved and to accord with Policies SWDP21, SWDP25, and SWDP27 of the South Worcestershire Development Plan and the relevant elements of the National Planning Policy Framework.
When the solar farm is no longer required for the purposes of electricity generation – either at the expiration of 41 years since completion of the installation (as set out in the previous condition) or at any time before that date where upon the Local Planning Authority shall be notified that the operation has ceased. Once the Local Planning Authority has acknowledged in writing that the use of the site for generating electricity has ceased, the installation shall be dismantled and all materials removed from site including the fencing, access tracks, sub-station and any other associated infrastructure/development and the land restored as far as is practicable to its former condition within six months of the acknowledged date of the cessation of the use.
Reason: To ensure that the proposal continues to operate in accordance with the details submitted and approved and to accord with Policies SWDP21, SWDP25, and SWDP27 of the South Worcestershire Development Plan and the relevant elements of the National Planning Policy Framework.
No obsolete or malfunctioning panels or equipment shall be stored on site without the prior approval of the details of the arrangements for the storage of such which shall be submitted to the Local Planning Authority for approval in writing. The development shall be carried operated in accordance with the approved details.
Reason: To ensure that the proposal continues to operate in accordance with the details submitted and approved and to accord with Policies SWDP21, SWDP25, SWDP27 and SWDP 33 of the South Worcestershire Development Plan and the relevant elements of the National Planning Policy Framework.
The applicant is requested to use his best endeavours to ensure that all HGV and Lorry delivery vehicles within the ownership, possession and control of the company or successor company or companies on the site or otherwise connected with construction process adhere in all respects to the submitted Construction Traffic Management Plan submitted by Transport Planning Associates dated May 2014.
It is suggested that representatives of Worcestershire County Council, as the Highway Authority and the applicant and/or agent should carry out a joint road survey/inspection on the road leading to this site. It is recommended that any highlighted defects should be rectified to a specification to be advised by the Highway Authority before work is commenced on the development hereby approved.
It is further recommended a further joint survey/inspection should be undertaken following completion of development hereby approved and any necessary remedial works should be completed to a specification to be advised by the Highway Authority within an agreed timescale.
The above works are suggested to ensure that the construction traffic association with the proposed development does not result in a deterioration of the public highway.
The applicant must be aware of their obligations towards the public right of way as
follows:
o No disturbance of, or change to, the surface of the path or part thereof should be carried out with written consent (this includes laying concrete, tarmac or similar) No diminution in the width of the right of way available for use by the public. Building materials must not be stored on the right of way.
o Vehicle movements and parking to be arranged so as not to unreasonably interfere with the public's use of the right of way.
o No additional barriers are placed across the right of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the Highway Authority.
o The safety of the public using the right of way is to be ensure at all times.
