The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans: Location Plan DH/7, Proposed Block Plan, Proposed Outbuilding Plans - Floor Plan, Front Elevation, Rear Elevation, Left Hand Elevation, Right Hand Elevation.
Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
The development hereby approved shall be used as a C3 dwellinghouse and child minding business only and for no other purpose, including any other purpose in Class E of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended), or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification.
Reason: Other uses within that Use Class may not be acceptable to the Local Planning Authority in this location having regard to the character and amenities of the area, in accordance with Policies SWDP2, SWDP21 and SWDP31 of the South Worcestershire Development Plan (February 2016) and the relevant aims and objectives of the National Planning Policy Framework.
The number of children occupying the premises as part of the child minding business hereby approved shall not exceed the maximum number of 6 at anyone time.
The development hereby permitted shall not be open to the occupation of children as part of a child minding business outside the following hours of 8am to 5pm Tuesday to Friday.
Reason: To ensure the proposal preserves residential amenity and to prevent unacceptable noise pollution to the detriment of human health contrary to policies SWDP21 and SWDP31 of the South Worcestershire Development Plan (February 2016) and the relevant aims and objectives of the National Planning Policy Framework.
The applicant should be aware that It is important that gas protection measures are properly designed, installed and verified to ensure that the site is suitable for use in terms of risks associated with ground gases.
Prior to construction, it is necessary to demonstrate that the design of the gas protection measures is appropriate for the level of risk associated with the site. It is important that the gas protection measures are properly installed and that once installed they are not inadvertently compromised by the actions of follow-on trades. Verification during the installation of the gas protection measures is necessary to demonstrate that they have been installed correctly and provide the required level of protection for the lifetime of the development.
The design, installation and verification of the installation of gas protection measures must be carried out in accordance with current guidance and best practice, namely:
- BS 8485:2015+A1:2019 "Code of practice for the design of protection measures for methane and carbon dioxide ground gases for new buildings";
- CIRIA C735 "Good practice on the testing and verification of protection systems for buildings against hazardous ground gases";
- NF94 - NHBC Foundation "Hazardous ground gas - an essential guide for housebuilders" April 2023.
Verification should always be carried out by an appropriate independent third party such as an experienced and suitably trained verification consultant or third party qualified and experienced installer. Examples include:
- assessors holding NVQ qualification in gas protection measures installation and/or NVQ qualification in verification of ground gas protection systems.
- a suitably qualified and experienced geo-environmental consultant
- assessors accredited by the CL:AIRE Gas Protection Accreditation Scheme
Please refer to CIRIA C735 and BS 8485:2015+A1:2019 for further information relating to verification requirements and minimum reporting requirements.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
