The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.


No development above damp proof course level shall commence until details of the materials to be used in the construction of the external surfaces of the replacement dwelling hereby permitted have been submitted to and approved in writing by the local planning authority. The details to be submitted shall include:-

- type, colour, texture, size, coursing, finish, jointing and pointing of brickwork/stonework;
- type, colour, texture, size and design of roofing materials;
- a precise specification of the proposed external render – and detailed specification of the mix, the number of coats and surface finish to be used;
- external joinery details along with architectural details of the proposed external finishes, heads, sills, position in wall reveal and any surrounding dressings
- details of external doors/garage doors including information on finish;

The development shall be carried out using the materials as approved.

Reason - To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan.


Temporary fencing for the protection of all retained trees/hedges on site and trees outside the site whose Root Protection Areas fall within the site shall be erected in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction) before development of any type commences, including site clearance, demolition, materials delivery, vehicular movement and erection of site huts. Any alternative fencing type or position not strictly in accordance with BS 5837 (2012) must be agreed in writing by the local planning authority prior to the commencement of development. This protective fencing shall remain in place until the completion of development or unless otherwise agreed in writing with the local planning authority. Nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area without the previous written consent of the local planning authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge. Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. This is in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan.


A landscape and ecological management plan (LEMP) shall be submitted to and be approved in writing by the local planning authority within one month of the commencement of the development hereby approved. The content of the LEMP shall be based on the recommendations for habitat compensation and enhancements contained within the Ecological Survey and Impact Assessment report by Countryside Consultants Ltd, dated 06/12/2023 and shall include appropriate measures to ensure the establishment of newly created and enhanced habitats as well as long term management options to ensure that the quality and function of these habitats can be maintained in the future.
The plan will be implemented in accordance with the approved scheme.

Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with SWDP 22.


The development hereby permitted shall be carried out in strict accordance with the recommendations set out in section 6 and Appendix 7 of the Ecological Survey and Impact Assessment report by Countryside Consultants Ltd Ecological Surveys dated 06/12/2023 and submitted with this application.

On completion of the works, and prior to occupation, the site shall be inspected by a suitably qualified ecologist to confirm that all measures contained within this report have been implemented in accordance with the details approved under this condition and to a satisfactory standard. A letter of certification shall thereafter be issued by the ecologist and confirmed in writing to the local planning authority.

Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.


Prior to the commencement of any works, including vegetation clearance and site preparation, a detailed construction environmental management plan (CEMP: Biodiversity) shall be submitted to and approved in writing by the local planning authority. The CEMP (Biodiversity) shall include the following:
a. Risk assessment of potentially damaging construction activities;
b. Practical measures (both physical measures and sensitive working practices) to avoid or reduce impacts during site clearance and construction;
c. The location and timing of sensitive works to avoid harm to biodiversity features;
d. The times during construction when specialist ecologists need to be present.

The approved CEMP shall be adhered to and implemented throughout the construction period strictly in accordance with the approved details, unless otherwise agreed in writing by the local planning authority.

Reason: To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and SWDP policy 22.


Before the commencement of development hereby permitted, details of renewable and/or low carbon energy generation measures shall be submitted to and approved in writing by the Local Planning Authority. The measures shall contribute to at least 10% of the predicted energy requirements of the development. The details to be submitted shall include:- - the overall predicted energy requirements of the approved development; - the predicted energy generation from the proposed renewable/low carbon energy measures; and - an implementation timetable for the proposed measures. The development shall be carried out in accordance with the approved details. Reason - To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan.


A "lighting design strategy for biodiversity" shall be submitted to and approved in writing by the local planning authority prior to the occupation of development hereby permitted. The strategy shall be based on the recommendations made in paragraph 6.3.2 and 6.3.3 of the Ecological Survey and Impact Assessment report by Countryside Consultants Ltd, dated 06/12/2023 and shall provide light contour modelling to ensure that LUX levels along the river bank and the base of the bank do not exceed 0.2 in the horizontal plane at ground level and 0.4 in the vertical plane.

All lighting shall be installed in accordance with the specifications and locations set out in the strategy, and these shall be maintained thereafter in accordance with the strategy. Under no circumstances should any other lighting be installed which could impact on the dark corridor along the river and its banks without prior consent from the local planning authority.

Reason: To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and to minimise impacts on with protected species in accordance with Policy SWDP22.


Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
