The following conditions and information notes are associated with the approval


The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.


Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 101 Proposed Block Plan ; 102 Proposed Elevation ; 103 Proposed Sections ; Existing site and Location Plan .

Reason: To define the permission.


Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.


The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Ecological Survey and Impact Assessment report carried out by Stewart Rampling dated November 2024 and submitted with this application. In particular: -


The works will not take place during the period 15th March - 15th June to avoid potential
disturbance to fish breeding.


Any removal of terrestrial vegetation will take place during the period 1st September through 28th February so as to avoid the bird nesting season. Where the works are to take place after the 15th June, the vegetation will be reduced to 100mm height by
carefully cutting and maintained through repeated cutting until the works take place.

For the installation of the water source heat pump connection below ground, the following
measures will be observed to avoid any risk of harm to reptiles:

(i) prior to commencement, a 2.5m wide strip of vegetation either side of the line of excavation (5m in total) will be carefully cleared of vegetation through hand operated tools, carefully reducing the vegetation back to just above ground level;
(ii) this sanitised strip will be maintained for the duration of the works;
(iii) any piles of materials such as branches, rubble or other potentially suitable shelters for reptiles within this strip will be cleared by a suitably qualified ecologist through finger tip search and recreated immediately adjacent to the strip;
(iv) the use of a mini digger, spreading of spoil and excavation will be restricted to the sanitised strip or existing mown grass areas;
(v) after installation, the strip will be subject to sowing with Emorsgate EP1 wildflower mix at the rate of 4g/m2
during the nest available window for seeding (August – October).

Prior to commencement, the site will be subject to inspection by a suitably qualified ecologist to ensure no otter is likely to be present and disturbed. The contractor will be given a tool box talk on the potential for disturbance to protected species and simple precautionary checks to be carried prior to starting work each day to ensure no otter is disturbed.

To compensate for the reduction in potential value of the bankside marginal habitat, 2 x 3m long pre-planted coir rolls with six native marginal plants per roll will be fixed to either side of the inlet for the slipway (12m length in total).

A further 18m of pre-planted coir roll will be fixed to the existing banks upstream of the landing stage to widen the margin and provide addition diversity of habitat. Fixing of coir rolls will be through timber stake driven into the river bank.

Eight roach spawning boards will be installed beneath the landing stage to provide
habitat for breeding fish.

The following bird and bat boxes will be installed to suitable trees on the site:
(i) 2 x open fronted woodstone bird boxes;
(ii) 2 x woodstone multi-chambered bat boxes


On completion of the works the development shall be inspected by a qualified ecologist and a statement of conformity shall be submitted to the Local Planning Authority to confirm whether all of the biodiversity mitigation and e nhancement measures have been implemented in accordance with the details approved under this condition.



Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.


In the event that contamination is found at any time when carrying out the approved development
that was not previously identified it must be reported immediately to the Local Planning Authority.
The applicant is advised to immediately seek the advice of an independent geo-environmental
consultant experienced in contaminated land risk assessment, including intrusive investigations
and remediation.

No further works should be undertaken in the areas of suspected contamination, other than that
work required to be carried out as part of an approved remediation scheme, unless otherwise
agreed by the Local Planning Authority, until requirements 1 to 4 below have been complied with:
1. Detailed site investigation and risk assessment must be undertaken by competent
persons in accordance with the Environment Agency's 'Land Contamination: Risk Management'
guidance and a written report of the findings produced. The risk assessment must be designed
to assess the nature and extent of suspected contamination and approved by the Local Planning
Authority prior to any further development taking place.
2. Where identified as necessary, a detailed remediation scheme to bring the site to a
condition suitable for the intended use by removing unacceptable risks to identified receptors
must be prepared and is subject to the approval of the Local Planning Authority in advance of
undertaking. The remediation scheme must ensure that the site will not qualify as Contaminated
Land under Part 2A Environmental Protection Act 1990 in relation to the intended use of the land
after remediation.
3. The approved remediation scheme must be carried out in accordance with its terms
prior to the re-commencement of any site works in the areas of suspected contamination, other
than that work required to carry out remediation, unless otherwise agreed in writing by the Local
Planning Authority.
4. Following completion of measures identified in the approved remediation scheme a
verification report that demonstrates the effectiveness of the remediation carried out must be
produced and is subject to the approval of the Local Planning Authority prior to the occupation of
any buildings on site.
REASON
To ensure that the risks from land contamination to the future users of the land and neighbouring
land are minimised, together with those to controlled waters, property, and ecosystems, and to
ensure that the development can be carried out safely without unacceptable risks to workers
neighbours and other offsite receptors.
