The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

Reason: In order to define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.


Hours of operation for the B8 use hereby permitted shall be limited to the following hours:
Monday – Saturdays 0800 - 1800 hours only
Sundays – 1800 – 2230 hours only

Reason: To ensure adequate amenity to nearby residential properties with regards to the numbers of vehicular movements along the access track in accordance with Policy SWDP21 of the South Worcestershire Development Plan, 2016.


Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 (as amended) the containers shall only be used for Class B8 use and for no other purpose of the Schedule to the Town and Country Planning (Use Classes) Order 1987, or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification.

Reason: In order that the Council may be satisfied about the details of proposal due to the particular character and location of this proposal and highways impacts and in order to comply with Policies SWDP1, SWDP2, and SWDP4 of the South Worcestershire Development Plan, and the relevant aims and objectives of the National Planning Policy Framework.


The B8 use hereby approved shall relate solely to the operation of the business entitled ‘Roly Poly Eats’ and the information contained within the Planning Statement (Enigma Planning) and Transport Statement (Enigma Planning) and for no other purpose.

Reason: To ensure that the proposal has been assessed based on the information submitted in regards to vehicular movements and the nature of the business and in order to comply with Policies SWDP1, SWDP2, and SWDP4 of the South Worcestershire Development Plan, and the relevant aims and objectives of the National Planning Policy Framework.


The Development hereby approved shall not be first occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material.

Reason: In the interests of highway safety and in order to comply with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan, and the relevant aims and objectives of the National Planning Policy Framework.


Prior to the installation details of any external lighting to be provided in association with the development shall first be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site.
Reason - To ensure the development contributes to the conservation and enhancement of biodiversity within the site and in the interests of safeguarding the rural landscape in this part in accordance with Policy SWDP22 and SWDP 25 of the South Worcestershire Development Plan, 2016.


There shall be no open storage of materials or equipment outside of the areas specifically denoted on the approved plan titled 'Proposed Site Plan', reference PS Rev 0, listed under Condition 2 of this Decision Notice.

Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area and to ensure safe highways access in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan, and the relevant aims and objectives of the National Planning Policy Framework.


Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- providing pre-application advice; - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
